By using shop.yleniacuellar.com (the “Site”) and purchasing artwork from it, you agree to the following terms and conditions. These terms are designed to clarify the purchase process and protect both your rights and mine as the artist and seller. Please read them carefully:

• Artist & Seller: This Site is operated by Ylenia Cuéllar and her team. All references to “we”, “us”, or “our” refer to Ylenia Cuéllar (the artist/owner of this shop). All photography artworks, site content, and designs are copyright © Ylenia Cuéllar.
• Product Authenticity: The prints sold here are exclusive photographic artworks by Ylenia Cuéllar. Each is produced on-demand to the highest quality standards. We guarantee that all descriptions of prints (including dimensions and materials) are accurate to the best of our knowledge. Minor variations in color can occur between what you see on your screen and the final printed artwork, due to calibration differences; such slight variations are not considered defects.
• Pricing & Payment: All prices are listed in EUR (Euro) unless otherwise noted. Prices exclude shipping (which will be added at checkout) and any applicable import taxes or duties (for international orders). We reserve the right to correct any obvious errors in pricing and to update prices or product information at any time. Payment is due at the time of order placement. We accept major credit cards, bank transfers, Apple Pay and Google Pay through a secure payment processor. We do not store your credit card information on our servers.
• Order Process: When you place an order and complete payment, you will receive an email confirmation summarizing your order details. This email signifies that we have accepted your order, at which point a binding contract of sale is formed. If you do not receive a confirmation, please contact us. We reserve the right to decline an order in rare cases (for example, due to suspected fraud or if a pricing error is identified) – if so, you will be contacted and any payment refunded.
• Production & Delivery: Upon order confirmation, we will begin the process of printing and framing your artwork. Please refer to our Shipping Information page for typical timelines. We are not liable for delays caused by third-party shipping carriers or unforeseen events (force majeure), but we will communicate and assist in tracking any delayed packages. Title (ownership) of the artwork passes to you upon full payment and shipment, but we retain a security interest until payment is complete. Risk of loss in transit is ours – we insure all shipments, so if a package is lost or damaged, we will take responsibility per our Return Policy.
• Returns & Cancellations: Because each print is custom-made for you, all sales are final. We do not accept returns or exchanges except in cases of damage or defect as outlined in our Refund & Return Policy above. Similarly, once production has started, orders cannot be canceled. By purchasing, you acknowledge that you have reviewed all order details (image, size, frame, etc.) and understand this no-returns policy for custom artwork. Your statutory rights are not affected; for instance, if an item is faulty, you are still entitled to a remedy.
• Intellectual Property & Usage Rights: Purchasing a print does not transfer the copyright of the image to you. Ylenia Cuéllar retains all rights to the artwork (photograph). You, as the buyer, obtain ownership of the physical print only​. No further usage rights are granted – this means you cannot reproduce, copy, scan, distribute, or create derivative works from the image. The print is for personal display only (whether in your home or private office). Public display of the artwork (e.g. in a gallery, restaurant, or other public space) or any commercial use requires prior written permission from the artist. However, you are of course free to resell the physical print in the future if you wish (as long as the new owner also understands these usage restrictions)​.
• Privacy & Data: We respect your privacy and handle your personal information responsibly. Please see our Privacy Policy below for details on how we collect and use your data. In short, any personal details collected during ordering (such as name, address, and email) are used only for processing your order, delivering the artwork, and communicating with you about your purchase or our news (if you opted into the newsletter). We do not sell or share your personal data with third parties for marketing purposes.
• Site Use: By browsing and using this Site, you agree not to engage in any activities that could harm the Site or interfere with others’ use of it. Unauthorized attempts to access secure areas or to use the Site for unlawful purposes are prohibited. The content on this Site (images, text, design) is the intellectual property of Ylenia Cuéllar. You may not use or reproduce any content without permission. Sharing images from this Site on social media is permitted only with proper credit to the artist.
• Governing Law: These terms and conditions are governed by the laws of France. This choice of law does not deprive you of any consumer protections under the law of your own country, to the extent those are applicable. In the event of a dispute that we cannot resolve amicably, French courts will have jurisdiction. As an EU-based seller, we also provide a link to the EU’s Online Dispute Resolution (ODR) platform as required, though we sincerely hope to resolve any issue directly with you.
• Updates to Terms: We may update these Terms & Conditions from time to time (for example, to reflect changes in the law, new features, or adjustments to our business practices). The latest revision date will be noted at the bottom of this page. By continuing to use the Site after such changes, you accept the revised terms. If a change is significant, we may also notify customers via email or a notice on the Site.
